Important: By completing a booking through rentihome.com, you agree to these Terms of Service in full. Please read them carefully before proceeding with payment.

1. Parties & Agreement

These Terms of Service ("Agreement") govern the rental relationship between TABB LLC, a limited liability company registered in the United States, operating the RentiHome platform ("Host," "we," "us," or "our"), and the individual completing a booking ("Guest," "you," or "your").

RentiHome provides short- and medium-term furnished apartment rental services in Barranquilla, Colombia. By submitting a booking request and/or completing payment through our platform, you confirm that you have read, understood, and agree to be bound by this Agreement, our Cancellation & Refund Policy, and any additional property-specific rules communicated at the time of booking.

You represent that you are at least 18 years of age and have the legal authority to enter into this Agreement.

2. Bookings & Reservations

2.1 Reservation Confirmation

A booking is not confirmed until full payment has been received and you have received a written confirmation email from RentiHome. We reserve the right to decline any booking at our sole discretion prior to confirmation.

2.2 Accuracy of Information

You are responsible for providing accurate personal information including your full name, email address, and phone number. RentiHome is not liable for any communication failures resulting from inaccurate information provided by the Guest.

2.3 Minimum Stay

Minimum stay requirements vary by property and booking period, as specified at the time of booking. Bookings below the applicable minimum stay will not be confirmed.

2.4 Availability

All listings are subject to availability. In the rare event that a confirmed property becomes unavailable due to circumstances beyond our control (force majeure, property damage, owner withdrawal), we will offer the Guest either a full refund or an alternative property of equal or greater value at no additional cost.

3. Payment Terms

3.1 Full Payment Required

Full payment for the entire stay is required at the time of booking. No reservation will be held without payment.

3.2 Payment Processing

Payments are processed securely through Stripe, Inc. By providing payment information, you authorize RentiHome to charge the full amount of your stay. RentiHome does not store credit card details.

3.3 Currency

All transactions are processed in US Dollars (USD) unless otherwise specified. The Guest is responsible for any currency conversion fees charged by their financial institution.

3.4 Failed Payments

If payment fails or is reversed after a booking is confirmed, the reservation will be immediately cancelled and dates will be released. RentiHome reserves the right to pursue any outstanding balance through available legal channels.

3.5 Taxes

The listed rental price is inclusive of applicable Colombian lodging taxes where required. RentiHome is responsible for remittance of taxes as required under Colombian law. The Guest is responsible for any taxes applicable in their home country.

4. Check-In & Check-Out

Standard check-in is from 3:00 PM and check-out is by 11:00 AM local Barranquilla time (COT, UTC-5). Early check-in and late check-out may be available upon request, subject to availability, and may incur an additional fee.

The full property address and access instructions will be provided via email and/or WhatsApp no later than 48 hours prior to your check-in date. It is your responsibility to ensure we have accurate contact details to receive this information.

If you fail to check in on your scheduled date without prior notice, the booking will be considered a no-show and no refund will be issued.

5. Occupancy & Guest Rules

5.1 Maximum Occupancy

Each property has a maximum occupancy limit specified in the listing. Exceeding this limit is strictly prohibited and may result in immediate termination of the stay without refund.

5.2 Registered Guests Only

Only the Guest named in the booking confirmation and their accompanying party (up to the occupancy limit) may reside in the property. Subletting or transferring the reservation to any third party is not permitted.

The following are strictly prohibited on all RentiHome properties:

Pets may be permitted on a case-by-case basis with prior written approval. Unauthorized pets may result in additional cleaning fees and/or termination of the stay without refund.

6. Property Use & Condition

6.1 Care of Property

Guests are expected to treat the property and its contents with reasonable care. You are responsible for any damage caused by you, your guests, or your pets beyond normal wear and tear.

6.2 Damage & Security Deposit

RentiHome reserves the right to charge the Guest's payment method on file for any damage exceeding normal wear and tear. We will provide photographic documentation of any damage claimed. Guests have 48 hours to dispute any damage charge.

6.3 Reporting Issues

Guests must report any maintenance issues, appliance failures, or pre-existing damage within 24 hours of check-in. Failure to report pre-existing damage may result in the Guest being held responsible.

6.4 Access for Repairs

RentiHome or designated maintenance personnel may access the property with reasonable advance notice (minimum 12 hours except in emergencies) to perform necessary repairs or inspections.

7. Limitation of Liability

Please read this section carefully — it limits our legal responsibility to you.

7.1 No Warranty

All properties are provided on an "as-is" basis. While we strive to ensure all listings are accurately described and well-maintained, RentiHome makes no warranties, express or implied, regarding the fitness of any property for a particular purpose.

7.2 Cap on Liability

To the maximum extent permitted by applicable law, RentiHome's total liability to any Guest for any claim arising out of or relating to a booking shall not exceed the total amount paid by that Guest for the stay giving rise to the claim.

7.3 Exclusion of Consequential Damages

RentiHome shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, loss of goodwill, personal injury, property damage not caused directly by RentiHome's negligence, travel disruption, medical expenses, or costs arising from force majeure events including but not limited to natural disasters, civil unrest, government actions, pandemics, utility failures, or acts of God.

7.4 Third-Party Services

RentiHome is not responsible for the acts or omissions of any third-party service providers including but not limited to airlines, transportation companies, medical providers, payment processors, or building management companies.

7.5 Personal Safety

The Guest assumes full responsibility for their personal safety and the safety of their accompanying guests during their stay. RentiHome strongly recommends that all Guests obtain comprehensive travel insurance covering medical emergencies, trip cancellation, and personal liability prior to travel.

7.6 Medical Tourism Disclaimer

RentiHome provides accommodation services only. We are not a medical provider and are not affiliated with any medical facility. Guests traveling for medical purposes do so entirely at their own risk. RentiHome is not responsible for any medical outcomes, complications, or expenses arising from medical procedures undertaken during a Guest's stay.

8. Indemnification

You agree to indemnify, defend, and hold harmless RentiHome, TABB LLC, its officers, members, employees, agents, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of any RentiHome property; (b) your violation of this Agreement; (c) your violation of any applicable law or regulation; (d) any claim by a third party arising from your conduct during your stay; or (e) any damage to the property caused by you or your guests.

9. Cancellation & Refunds

Cancellations and refunds are governed by our Cancellation & Refund Policy, which is incorporated into this Agreement by reference. Please review that policy carefully before booking, as our policy is strict and designed to protect both parties.

10. Dispute Resolution

10.1 Good Faith Resolution

In the event of any dispute, both parties agree to first attempt resolution in good faith through direct communication via email or WhatsApp within 14 days of the dispute arising.

10.2 Binding Arbitration

If a dispute cannot be resolved through good faith negotiation, it shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) for disputes up to USD $10,000, or through a mutually agreed arbitrator for larger claims. Arbitration shall be conducted in English.

10.3 Class Action Waiver

You agree to resolve any disputes with RentiHome on an individual basis. You waive any right to bring or participate in any class action, collective action, or representative proceeding against RentiHome.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions, except where mandatory local Colombian consumer protection laws apply to the physical rental of property within Colombia.

12. Miscellaneous

12.1 Entire Agreement

This Agreement, together with the Cancellation & Refund Policy and any booking confirmation, constitutes the entire agreement between the parties and supersedes all prior communications, representations, or agreements relating to the subject matter herein.

12.2 Severability

If any provision of this Agreement is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

12.3 Waiver

Failure by RentiHome to enforce any provision of this Agreement shall not constitute a waiver of our right to enforce that provision in the future.

12.4 Amendments

RentiHome reserves the right to update these Terms at any time. Material changes will be communicated via email. Continued use of our services after notice of changes constitutes acceptance of the revised Terms. The Terms in effect at the time of your booking shall govern that booking.
